Questions

J1 insurance, answered with sources.

01

What insurance does a J1 exchange visitor need?

Under 22 CFR 62.14(b), the policy must provide medical benefits of at least $100,000 per accident or illness, $25,000 for repatriation of remains, $50,000 for medical evacuation to the home country, and a deductible of no more than $500 per accident or illness.

Source: 22 CFR 62.14(b)(1) to (4)

02

Which insurer ratings qualify for J1 insurance?

Section 62.14(d)(1) accepts an underwriter rated A.M. Best A− or above, S&P claims paying ability A− or above, Weiss B+ or above, Fitch A− or above, or Moody's A3 or above. A policy can also qualify if it is backed by the full faith and credit of the home country government, is a group plan a designated sponsor offers to its employees or enrolled students, or is offered through a federally qualified HMO or eligible Competitive Medical Plan.

03

Do J2 dependents need the same insurance?

Yes. Section 62.14(h) requires accompanying spouses and dependents to be insured in the amounts set in paragraph (b), and sponsors must tell exchange visitors about this in writing before they arrive in the United States.

Source: 22 CFR 62.14(a) and (h)

04

Can a J1 policy have a waiting period for pre existing conditions?

Yes. Section 62.14(c)(1) allows a waiting period for pre existing conditions that is reasonable as determined by current industry standards. The regulation does not set a number of months, so your sponsor judges whether a waiting period is reasonable.

Source: 22 CFR 62.14(c)(1)

05

How much coinsurance can a J1 plan have?

Section 62.14(c)(2) allows coinsurance under which the exchange visitor pays up to 25% of covered benefits per accident or illness.

Source: 22 CFR 62.14(c)(2)

06

How long must J1 insurance last?

For the whole program. Section 62.14(b) defines the required period as the exchange visitor's actual participation as recorded in SEVIS, from the Program Begin Date to the Program End Date, Effective Program End Date or Effective Date of Termination.

Source: 22 CFR 62.14(b)

07

Who decides whether my J1 insurance is acceptable?

Your sponsor. The Department of State says sponsors verify that a participant's insurance meets the regulatory requirements. Under 62.14(i) and (j), willfully failing to keep the required coverage, or misrepresenting it, can lead to termination from the program.
